Jetset Terms of Service

Welcome to Jetset. These Terms of Service ("Terms") govern your access to and use of the Jetset application, website, and related services (collectively, the "Services") provided by NP Studios LLC ("Jetset," "we," "us," or "our"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
1. Eligibility
You must be at least 13 years old (or 16 in the European Economic Area) to use the Services. By using the Services, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into these Terms. If you are using the Services on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
2. Your Account
To use certain features of the Services, you may need to create an account using a third-party sign-in provider (such as Google or Apple). You are responsible for:

Maintaining the confidentiality of your account credentials.

All activity that occurs under your account.

Notifying us promptly of any unauthorized access or security breach.
We reserve the right to suspend or terminate accounts that violate these Terms or engage in activity we reasonably determine to be harmful, abusive, or unlawful.
3. Acceptable Use
You agree not to:

Use the Services for any unlawful purpose or in violation of any applicable law or regulation.

Upload or transmit content that is illegal, infringing, defamatory, harassing, or harmful.

Attempt to gain unauthorized access to the Services, other users' accounts, or our systems.

Reverse engineer, decompile, or disassemble any part of the Services.

Use automated tools (bots, scrapers, crawlers) to access the Services without our written permission.

Interfere with, disrupt, or overload the Services or their infrastructure.

Resell, sublicense, or commercially exploit the Services without our written consent.
4. User-Generated Content
The Services allow you to upload, create, and store content, including itineraries, journal entries, photos, videos, expenses, and travel documents ("User Content").
Your ownership. You retain ownership of your User Content. We do not claim any rights to your creative or personal content.
Your license to us. By uploading User Content to the Services, you grant Jetset a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and process that content solely for the purpose of operating and improving the Services on your behalf.
Your responsibility. You are solely responsible for your User Content and represent that you have all rights necessary to upload it and that it does not violate any third party's rights or applicable law.
5. AI-Generated Content
Jetset uses third-party artificial intelligence services (including but not limited to Google Generative AI) to generate travel itineraries and suggestions based on your inputs.
You understand and agree that:

AI-generated content may contain inaccuracies, outdated information, or errors.

You should independently verify important travel details (visa requirements, opening hours, prices, safety conditions, etc.) before relying on them.

Jetset is not responsible for decisions you make based on AI-generated suggestions.

AI-generated content is provided "as is" without warranty of any kind.
6. Intellectual Property
The Services, including all software, branding, logos, designs, text, graphics, and other content (excluding User Content), are the exclusive property of Jetset and its licensors, and are protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, revocable, non-exclusive, non-transferable license to use the Services solely for your personal, non-commercial use in accordance with these Terms.
7. Third-Party Services
The Services may integrate with or link to third-party services (Google, Apple, HubSpot, Firebase, AI providers, and others). Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services and do not endorse them.
8. Fees and Payment
Some features of the Services may be offered on a paid basis in the future. If we introduce paid features:

Pricing and payment terms will be clearly disclosed before purchase.

Charges are non-refundable except where required by law.

You are responsible for any applicable taxes.
During any early-access or beta period, use of the Services may be free or subject to different terms, which we will communicate separately.
9. Modifications to the Services
We may add, change, or remove features of the Services at any time without notice. We may also suspend or discontinue the Services in whole or in part. We are not liable to you for any modification, suspension, or discontinuation of the Services.
10. Termination
You may stop using the Services and delete your account at any time.
We may suspend or terminate your access to the Services immediately, without prior notice, if:

You violate these Terms.

We are required to do so by law.

Continued use of the Services would create risk to us, other users, or the Services.
Upon termination, your right to use the Services ceases immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitations of liability, and dispute resolution) will survive.
11. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT DATA WILL NOT BE LOST. WE ARE NOT RESPONSIBLE FOR TRAVEL DECISIONS, BOOKINGS, OR OUTCOMES BASED ON INFORMATION PROVIDED THROUGH THE SERVICES.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, JETSET AND ITS OFFICERS, EMPLOYEES, AFFILIATES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.
13. Indemnification
You agree to defend, indemnify, and hold harmless Jetset and its officers, employees, and affiliates from any claims, damages, liabilities, losses, or expenses (including reasonable attorneys' fees) arising from:

Your use of the Services.

Your User Content.

Your violation of these Terms.

Your violation of any third-party rights or applicable law.
14. Governing Law and Disputes
These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict of laws principles.
Any dispute arising from these Terms or the Services will be resolved through binding arbitration on an individual basis in Atlanta, Georgia, except that either party may seek injunctive relief in a court of competent jurisdiction for intellectual property infringement or unauthorized access.
You and Jetset each waive the right to a jury trial and the right to participate in class actions.
15. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by updating the "Last Updated" date at the top of these Terms and, where appropriate, by providing additional notice (such as an email or in-app notification). Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
16. Miscellaneous

Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Jetset regarding the Services.

Severability. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.

No waiver. Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

Assignment. You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
